These Terms and Conditions (“Terms”) govern your access to and use of the website https://www.pacfundedtrader.com (the “Site”) and the proprietary trading evaluation services (the “Services”) operated under the PacFundedTrader brand (“we,” “us,” or “our”). By accessing or using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility and Acceptance

You must be at least 18 years of age to access or use the Services. By using the Services, you confirm that you meet this requirement and that you are legally permitted to participate in simulated trading evaluations under applicable laws in your jurisdiction.

2. Nature of the Services

PacFundedTrader provides simulated trading evaluation programs designed to assess trading performance, risk management, and rule compliance.

All trading activity occurs in a simulated environment using virtual funds.
No real capital is traded, deposited, or invested at any stage.

Any payouts offered by PacFundedTrader are performance-based rewards issued under the program rules and do not represent profits generated from live financial markets.

3. No Financial Advice

Nothing on the Site or within the Services constitutes financial advice, investment advice, or a recommendation to trade any financial instrument. You acknowledge that all trading decisions are made independently and at your own risk.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. You agree to provide accurate and current information during registration and to update it as necessary.

PacFundedTrader is not responsible for losses or issues arising from unauthorized account access due to user negligence.

5. Fees and Non-Refundable Services

All fees paid for evaluation programs are non-refundable.

Evaluation programs are offered on a recurring subscription basis, billed according to the selected plan and billing cycle.

By subscribing to an evaluation program, you enter into a binding contract for delivery of a digital simulated trading service for the duration of the active subscription, regardless of outcome.

No refunds will be issued for:

Failure to pass the evaluation
Rule violations
Account termination
User error
Technical issues
Voluntary cancellation

All subscription fees and billing periods are final and non-refundable once charged.

6. Evaluation Rules and Failure Conditions

Evaluation rules, profit targets, drawdown limits, daily loss limits, and trading parameters are defined within the user dashboard and form part of these Terms.

Any violation of the rules may result in:

Immediate evaluation failure
Account termination
Loss of eligibility for payouts
No refund

Rules displayed in the dashboard take precedence over any marketing or descriptive content.

7. Prohibited Trading Practices

The following activities are strictly prohibited:

Latency arbitrage or data feed exploitation
Hedging across multiple accounts
Coordinated, mirrored, or copy trading
Use of prohibited automated systems or bots
Manipulation of simulated market conditions
Abuse of platform systems or rules

Violations may result in immediate account termination and forfeiture of rewards.

8. Payout Review and Withholding

PacFundedTrader reserves the right to review all payout requests. Payouts may be delayed, withheld, or denied if:

Rule violations are detected
Trading activity is under review
Additional verification is required
Suspicious or abusive behavior is identified

All payout decisions are final.

9. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate access to the Services at any time for:

Rule violations
Misrepresentation
Abuse of the platform
Reputational risk
Legal or compliance concerns

We may reset accounts, nullify trades, or restrict features without compensation.

10. Intellectual Property

All content, systems, trademarks, and materials on the Site are owned or licensed by PacFundedTrader. You are granted a limited, non-transferable, revocable license to use the Services solely for personal participation in evaluation programs.

11. Limitation of Liability

To the maximum extent permitted by law, PacFundedTrader shall not be liable for indirect, incidental, consequential, or special damages.

Total liability, if any, shall not exceed the amount paid by you for Services within the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless PacFundedTrader from any claims, losses, damages, or expenses arising from:

Your use of the Services
Violation of these Terms
Breach of applicable laws
Public statements causing reputational harm

13. Governing Law and Arbitration

These Terms are governed by the laws of the United States.

Any dispute arising from or related to these Terms or the Services shall be resolved by binding arbitration conducted in the State of Wyoming, in the English language, in accordance with applicable arbitration rules.

You waive the right to participate in:

Class actions
Collective proceedings
Representative claims

All disputes must be brought individually.

14. Changes to These Terms

PacFundedTrader may update these Terms at any time. Updated versions will be posted on the Site. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
